AMTRAK / FRANKLIN SQUARE “HOME FOR THE HOLIDAYS” SWEEPSTAKES Enter for a chance to win two round-trip tickets on the Acela Express® train for travel between Washington, DC and Boston, MA. Entries are accepted between November 1 and December 31, 2008. The drawing will be made on January 6, 2009. OFFICIAL RULESNO PURCHASE NECESSARY
1. Eligibility. This promotion is open only to individuals 18 years of age or older as of November 1, 2008, who when entered shall be referred to as “Entrant”. Individuals under 18 years of age as of November 1, 2008 are not eligible to enter. Valid in the United States of America, except where prohibited or restricted by law. Employees, directors and their immediate family members (spouse, parents, children and their spouses) of Historic Philadelphia, Inc. (“Sponsor”), Amtrak (“Partner”) and their affiliates, subsidiaries, advertising and promotion agencies, and/or those living in the same household, are not eligible for this promotion. Promotion is subject to all federal, state and local laws and regulations. By participating, Entrant agrees to these Official Rules, and accepts all decisions of the Sponsor as final. This promotion shall be construed pursuant to the laws of the Commonwealth of Pennsylvania and the United States. Entrants must be residents of the United States at the time of their entry into this promotion.
2. How to Enter. Entrants may enter this promotion by one of the following methods: (i) fully and properly completing an official printed Sweepstakes Entry Form, and submitting it in an official Entry Box at Franklin Square, 6th & Race Streets, Philadelphia, PA; or (ii) by mail: hand print your full name, age, complete home address, daytime phone number, and e-mail address on a 3” by 5” card, place into a stamped envelope, and mail to: Franklin Square, Attn: Home for the Holidays Sweepstakes, 116 S. Third Street, Philadelphia, Pennsylvania, 19106. No printed or mechanical reproductions or facsimiles accepted. Mail-in entries must be postmarked by December 31, 2008. Entries will be accepted between 12:01 AM EST on November 1, 2008 and 6:00 PM EST on January 6, 2009. Entries that do not include all of the required information are void. Limit one (1) entry per person for the Grand Prize provided, that Entrants submitting an entry on behalf of a child under 18 years of age may submit one (1) entry for each child in their household. Except as set forth herein, if more than one entry is received from the same household, all entries from that household shall be void.
3 Prizes and Winner Selection. Grand Prize: One (1) Grand Prize winner will be selected on January 6, 2009 in a random drawing from the eligible entries submitted. The Grand Prize is Two (2) round-trip, business class tickets on the “Acela Express” for travel between Washington, DC and Boston, MA. Except as expressly set forth, food, souvenir purchases, lodging, and other costs are not included in the prize. The prize will be awarded and the winners will be notified by phone, mail, and/or e-mail, at the Sponsor’s discretion. If a selected winner cannot be reached or does not respond within seventy-two (72) hours of the first notification attempt, is found to be ineligible, or declines to accept the prize, the potential winner may be disqualified in Sponsor’s discretion, and in such case Sponsor will select an alternate winner in a random drawing from remaining eligible entries. Each prize is non-transferable and no substitution is allowed, except by the Sponsor who reserves the right to award a prize (or portion of a prize) of equal or greater value if the advertised prize (or a portion thereof) is unavailable.
4. Prize Terms and Conditions. A prize, and each portion thereof, is subject to availability and restrictions. A prize will no longer be honored by the participating establishments after the specific dates for its use, as indicated thereon. Except as expressly provided herein, all federal, state, and local taxes, gratuities, transportation costs, meals and incidental expenses are the sole responsibility of the prizewinner. Sponsor will not replace any lost or stolen tickets. Admission to the “Acela Express” is subject to Partner’s age, dress code, and other rules. A prize cannot be used in conjunction with any other promotion or offer. A prize (or any portion thereof) cannot be redeemed for cash, transferred, assigned or substituted. Sponsor assumes no responsibility or liability for damages, losses or injury resulting from acceptance or use of a prize, or from acts/omissions of a participating establishment. Each person selected as a winner is subject to eligibility verification and compliance with these Official Rules. A winner (or parent/guardian, if winner under 18 years of age) may be required to sign and return a notarized Affidavit of Eligibility/Liability Release of Liability within ten (10) days of prize notification. If a winner declines to sign this document, the prize may be forfeited and an alternate winner may be selected.
5. General Rules. By entering, Entrants agree to be bound by the Official Rules and Sponsor’s decisions. Also, by entering each Entrant further agrees to release, indemnify, defend, and hold harmless Sponsor, its affiliates, Partner, its affiliates, any entity associated with the production, administration or fulfillment of the promotion, and their parents, subsidiaries, officers, directors, employees, representatives and agents, from and against any and all liability or injuries, losses or damages of any kind, to persons or property, including death, resulting in whole or in part, directly or indirectly, from this promotion, use of any prize won or in any promotion-related activity. Sponsor and any other entity associated with this promotion are not responsible for inaccurate or incorrect information or technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, tampering, or by any of the equipment or programming associated with or utilized in this promotion, which may limit the ability to participate, or by any human error which may occur in the processing of the entries in this promotion. Sponsor may disqualify any person who tampers with or abuses any aspect of this promotion, or who acts in violation of these rules, or acts in any manner to threaten or abuse or harass any person. Should any portion of this promotion be compromised by software defects, virus, non-authorized human intervention or other causes that corrupt or impair administration, security, fairness, or proper play of this promotion, or submission of entries, Sponsor may suspend, modify, or terminate the promotion in its discretion, and randomly select winner from the valid entries received prior to such action.
6. Use of Winners’ Names & Likenesses: Acceptance of a prize constitutes Entrant’s permission for Sponsor to use his/her name, hometown, photograph, likeness, voice and statements, as well as those of any minor (under 18) on whose behalf Entrant entered this promotion, for promotional purposes without further compensation, notice or permission, except where prohibited by law.
7. Disputes. In the event of any dispute, all parties agree that the judgment and decision of the Sponsor shall be final and binding in the awarding of the prize. Any and all legal actions that may be brought by any party shall be resolved exclusively in the courts of the Commonwealth of Pennsylvania located in Philadelphia, Pennsylvania.
8. Winners’ Names: For the name of the winners, send a self-addressed, stamped #10 envelope to the Sponsor by January 31, 2009.
9. Privacy Notice. Any personal information entrants provide by entering this promotion may be used for the marketing purposes of Sponsor.
10. Sponsor. The Sponsor of this promotion is the Historic Philadelphia, Inc. d/b/a Franklin Square, 116 S. Third Street, Philadelphia, PA 19106.
